Official Rules

 

 

The following promotion is intended for participants in the fifty (50) United States and Washington, D.C. only and shall be construed and evaluated according to the laws of the United States. Do not proceed in this promotion if you are not a legal resident of the fifty (50) United States or Washington, D.C. Further eligibility restrictions are contained in the official rules (“Official Rules”) below. Entrants are providing information to the Sponsor and not to Instagram. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED, OR ADMINISTERED BY, OR ASSOCIATED WITH INSTAGRAM. 

 

  1. SWEEPSTAKES DESCRIPTION: The Goldfish® Glitter & Goldfish New Year’s Sweepstakes (the “Sweepstakes“) begins on Friday, December 27, 2024, at approximately 10:00:01 am Eastern Time (“ET“) and ends on Tuesday, December 31, 2024, at 11:59:59 pm ET (“Sweepstakes Period“). The sponsor of this Sweepstakes is The Campbell’s Company, One Campbell Place, Camden, NJ, 08103 (“Sponsor“). The administrator of this Sweepstakes is Creative Zing Promotion Group, 2100 E. Robinson Street, Orlando, FL 32803 (“Administrator“). The Sponsor and Administrator are collectively referred to below as the “Sweepstakes Entities“.

 

  1. ELIGIBILITY: Sweepstakes is open only to legal residents of the fifty (50) United States and Washington, D.C. (i.e., excluding Guam, Puerto Rico and all other U.S. territories and possessions), who are physically located and residing therein and who meet the following criteria (each, an “Entrant”):
  • Entrant must be at least eighteen (18) years of age and the age of legal majority in their state of primary residence at time of entry;
  • Entrant must be a registered user of Instagram and comply with Instagram’s Terms of Use. Instagram can be obtained for free by visiting Google Play or the iTunes App store and downloading the app, or by logging on to www.instagram.com and following the onscreen prompts to create a profile;
  • Entrant must be the rightful owner of the non-private Instagram account associated with the entry. In the event of a dispute, the Entrant or potential winner will be deemed the Authorized Account Holder of the Instagram account as long as such individual is otherwise eligible in accordance with these Official Rules. “Authorized Account Holder” is defined as the natural person in whose name the Instagram profile was opened. In the event a dispute regarding the identity of an Entrant or potential winner cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible; and
  • Entrant must NOT be an employee, shareholder, officer, director, agent or representative of the Sweepstakes Entities, or any of their respective parent companies, affiliates, divisions, subsidiaries, agents, representatives or promotion and advertising agencies, nor can Entrant be an Immediate Family Member and/or Household Member of such persons. For purposes of the Sweepstakes, “Household Members” shall mean those people who share the same residence at least three months a year; “Immediate Family Members” shall mean parents, step-parents, legal guardians, children, stepchildren, siblings, stepsiblings or spouses.

 

  1. HOW TO ENTER: During the Sweepstakes Period, the Entrant must log into their Instagram account and visit https://www.instagram.com/goldfishsmiles/?hl=en (“Sponsor Instagram Page“).
  • If the Entrant is not already a follower of the Sponsor Instagram Page, the Entrant must click the “Follow” button to become a follower.
  • During the Sweepstakes Period, followers of the Sponsor Instagram Page will have the opportunity to see the Sweepstakes call-to-action post (the “ Entry Post“) in their Instagram feed. The Entry Post is also available by visiting the Sponsor Instagram Page.
  • Eligible Entrants must follow @goldfishsmiles on Instagram, “Like” the Entry Post and respond to the prompt “Comment your favorite Goldfish to snack on” in the form of a comment (the ” Comment“) on the post;
  • Comment must include #GoldfishSweepstakes to automatically receive one (1) “Entry” into the Sweepstakes.

 

Comments must answer the prompt posed in the Entry Post to be eligible for the Sweepstakes. If any Comment contains material that is violent, pornographic, obscene, illegal, inappropriate, racially or morally offensive, disparaging to the Sponsor or Sponsor’s products/services, or if any Comment or Entrant fails to comply with these Official Rules or otherwise meet Sponsor’s standards for any reason, as determined by the Sponsor in its sole discretion, such Comment will be rejected as ineligible and/or deleted, and the Entrant responsible for such Comment may be disqualified from participation in the Sweepstakes. Entries must comply with all applicable laws, rules, and regulations.

 

Limit one (1) Entry per person. All entries must be received by Tuesday, December 31, 2024, at 11:59:59 pm ET. Any attempt by an Entrant to obtain more than the stated number of entries by using multiple/different identities, registrations, logins, and/or any other methods will void such Entrant’s excess entries, and that Entrant may be disqualified from the Sweepstakes. Entries generated by a macro, script, or other automated means will be disqualified. All entries become the sole property of the Sponsor. NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED. Participation in the Sweepstakes constitutes the Entrant’s understanding of and full and unconditional agreement to and acceptance of these Official Rules. Sponsor reserves the right to disqualify any Entrant that Sponsor determines to violate any term contained in these Official Rules.

 

Entrants must follow the Sponsor Instagram Page throughout the Sweepstakes Period and for at least twenty (20) days thereafter (for notification purposes). Entrants may unfollow the page after the twenty (20) day notification period. ENTRANTS MUST VERIFY THEIR INSTAGRAM SETTINGS TO ENSURE THEY CAN RECEIVE DIRECT MESSAGES FROM SPONSOR PROFILE. If an Entrant chooses to Comment via his or her web-enabled mobile device, data rates may apply. See the applicable wireless service provider for details on rates and capabilities.

 

  1. ODDS OF WINNING: Odds of winning depend on the number of eligible entries received.

 

  1. PRIZE: One (1) “Prize” is available in the Sweepstakes: one (1) custom, decorative 30 oz Goldfish® Cheddar Cheese Crackers carton; one (1) 6.6 oz package of Goldfish® Cheddar Crackers; one (1) 6.6 oz package of Goldfish® Colors; one (1) 6.6 oz package of Goldfish® Parmesan; one (1) 6.6 oz package of Goldfish® Pizza: one (1) 6.6 oz package of Goldfish® Pretzel. Approximate Retail Value (“ARV”): $320;

 

PRIZE WILL BE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED BY SPONSOR. All Prize details are at the sole discretion of the Sponsor. Prize winner cannot assign or transfer the Prize to another person. If the Prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded. If a winner cannot accept a Prize, or any portion thereof, as stated, the Prize may be forfeited at the sole discretion of Sponsor. The value of the Prize represents Sponsor’s good faith determination of the maximum retail value thereof. No refunds or credit for changes are allowed. The ARV of any Prize is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the Prize is awarded or redeemed. The winner will be solely responsible for all federal, state and/or local taxes, if applicable, and for any other fees or costs associated with the Prize they receive. The stated ARV of the Prize is based on available information provided to Sponsor and the value of the Prize awarded to a winner may be reported for tax purposes as required by law.  Other restrictions may apply.

 

If a Prize is valued at $600 or more, the winner must provide Sponsor with a valid social security number before the Prize will be awarded for tax reporting purposes and an IRS Form-1099 may be issued for the actual value of the Prize received. Other restrictions may apply. If Prize is awarded but goes unclaimed or is forfeited by recipient, the Prize may not be re-awarded, in Sweepstakes Entities’ sole discretion.

 

  1. WINNER SELECTION AND NOTIFICATION: The potential winner will be selected in a random drawing conducted by the Administrator from all eligible entries within approximately five (5) business days of the end of the Sweepstakes Period. The potential winner will be notified in the form of a direct message or comment on Instagram from the Sponsor Instagram Page. The potential winner will be required to respond (as directed) to the notification within seventy-two (72) hours (or a shorter time if required by exigencies) of attempted notification. The failure to respond timely to the notification may result in forfeiture of the opportunity to claim the prize. The potential winner will be required to verify address, sign, and return within three (3) days of initial notification one or more forms covering eligibility, liability, advertising and (unless prohibited by law) publicity rights and such other documents as Sponsor or Administrator may require (collectively, “Prize Acceptance Forms”). Failure to return the Prize Acceptance Forms within the specified time period may result in forfeiture of the prize and selection of an alternate potential winner from the remaining eligible entries.

 

A prize will not be awarded until all such properly executed Prize Acceptance Forms are returned. Sweepstakes Entities, in their sole discretion, will attempt to contact up to three (3) potential winners of a prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. Sweepstakes Entities reserve the right to disqualify anyone not fully complying with the Official Rules.

 

  1. CONDITIONS OF PARTICIPATION/RELEASES: Sweepstakes is void where prohibited or restricted by law. All federal, state, and local laws and regulations apply. By participating, each Entrant agrees to be bound by these Official Rules and the decisions of the Sponsor, which shall be final in all respects. By participating in this Sweepstakes and/or by accepting any Prize that they may win, each Entrant agrees to indemnify, defend, hold harmless and release the Sweepstakes Entities and each of their respective parent, subsidiary and affiliated companies, units and sponsors, divisions and advertising and promotional agencies and Prize suppliers and all entities involved in the production, sponsorship and/or promotion of the Prize, or any part thereof (collectively, the “Released Parties“) from any and all liability for any actions, claims, injury, loss, damage, expense, including reasonable attorneys’ fees and costs of any kind arising in any manner, directly or indirectly, from participation in this Sweepstakes and/or acceptance or use of the Prize. Each Entrant authorizes the Sweepstakes Entities to use his/her name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material in any and all media, worldwide in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Sweepstakes Entities are not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials at Sweepstakes Entity’s sole discretion without further obligation or compensation. The Released Parties shall not be liable for: (i) late, lost, delayed, damaged, stolen, misdirected, postage-due, incomplete, unreadable, inaccurate, garbled or unintelligible entries, release forms, communications or affidavits, regardless of the method of transmission; (ii) phone system, phone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any and all losses, damages, rights, claims and action of any kind in connection with or resulting from participation in the Sweepstakes; (v) acceptance, possession, grant, or use of any prize, including without limitation, personal injury, death and property damage arising therefrom; (vi) claims based on publicity rights, defamation or invasion of privacy; or (vii) any printing, typographical, human administrative or technological errors in any materials associated with the Sweepstakes. Sweepstakes Entities disclaim any liability for damage to any phone or computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes (or any portion of the Sweepstakes) should a virus, bug, computer problem, unauthorized intervention or other cause or problem corrupt or inhibit the administration, security or proper play of the Sweepstakes and, in such situation, to select the winner(s) from among all eligible non-suspect entries received prior to and/or after such action or in such manner as deemed fair and appropriate by the Sponsor. Sponsor may prohibit you from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or any other unfair playing practices or intending to annoy, abuse, threaten or harass any other participants or Sponsor’s representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

 

  1. INDEMNITY: Entrant shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages, actions, liability, loss, injury or expense, including reasonable attorneys’ fees and costs, arising out of or in connection with: (a) Entrant’s participation in the Sweepstakes; (b) a breach or allegation which if true would constitute a breach, of any of Entrant’s representations, warranties or obligations herein; and (c) acceptance, possession, grant, participation in, or use of any Prize, including without limitation, personal injury, death and property damage arising therefrom.

 

  1. PRIVACY POLICY: Any personal information supplied by you to Sponsor will be subject to privacy policy posted at https://www.thecampbellscompany.com/privacy-policy/ (“Sponsor’s Privacy Policy”). By entering the Sweepstakes, you grant Sponsor permission to share your Instagram profile, email address, and any other personal information with the other Sweepstakes Entities for the purpose of administration and Prize fulfillment. Sponsor will not sell, rent, transfer or otherwise disclose your personal data submitted in connection with your entry to any third party other than the corresponding Sweepstakes Entities and as explicitly described herein and in Sponsor’s Privacy Policy.

 

  1. WINNER LIST/OFFICIAL RULES: To obtain a copy of the Winner list or a copy of these Official Rules, send your request along with a stamped, self-addressed envelope to Creative Zing Promotion Group, ATT “Glitter & Goldfish New Year’s Sweepstakes” Winner List/Rules, 2100 E. Robinson, Orlando, Florida, 32803. Winner list requests must be received no later than March 1, 2025. Vermont residents may omit return postage.

This Sweepstakes is in no way sponsored, endorsed or administered by Instagram. Instagram is completely released of all liability by each Entrant in this Sweepstakes.
